This came up in another thread, since the deck size is known and equal piles are created, the amount of cards per Epidemic is known. This just creates a visual representation. You can achieve the same outcome by tracking number of turns.

Technically rules set about to describe the things you CAN do rather than the things you can't. The rules don't say I can't take all the money from the bank in Monopoly for instance. They describe how and when you CAN get money from the bank.
