I get the point tie breaking thing, what I don't get is how someone would have 20 structures when there's only 17 on your board total to build. Is this just a simple mistake, and using 10 and 9 would have been better?

Funny, how nobody has noticed that! You're completely right. I didn't even question these numbers back when translating as, as you say, their point is to explain tie-breaking, but they surely are unrealistic (not to say impossible).
