You don't get a bounty for defeating a merchant player - that is only for defeating a Naval ship (these are the four brown ships - other ships are not Naval ships). So you only get one bounty for the attack on a non-pirate ship and so here you could use clemency.
However if it was a Naval ship, then you are right. Here you get one bounty for attacking and one more if you win, so then you could not use clemency.
Actually you could use it in between to get rid of the first bounty, but there would rearly be any point in doing this (players are prohibited from playing non-combat related Glory cards when combat has started, but I don't think there is anything about using the effect of event cards).
